These Terms of Service (“Terms”) govern your access to and use of this website (the “Site”), operated by BURLY PIRATE LLC d/b/a 710 Pipes (“710 Pipes,” “we,” “us,” or “our”), and any purchases made through the Site. By accessing or using the Site, you agree to be bound by these Terms, our Privacy Policy, our Return & Refund Policy, and our Shipping Policy (collectively, the “Agreement”). If you do not agree, you may not use the Site.
1. Eligibility and Age Requirement
Our products are sold strictly to individuals 21 years of age or older. By using the Site, you represent and warrant that:
- You are at least 21 years of age;
- You are legally permitted to purchase our products in your jurisdiction; and
- You have the legal capacity and authority to enter into this Agreement.
Misrepresenting your age or identity may result in order cancellation and account termination.
2. Use of the Site and License
Subject to your compliance with these Terms, 710 Pipes grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use. Under this license you may not:
- Modify, copy, or create derivative works based on the Site or its materials;
- Use the Site or its materials for any commercial purpose without our prior written consent;
- Attempt to decompile, reverse engineer, or otherwise extract source code from the Site or any software associated with it;
- Remove, obscure, or alter any copyright, trademark, or other proprietary notices; or
- “Mirror” or frame the Site or any part of it on any other server or website.
This license terminates automatically if you breach these Terms and may be terminated by 710 Pipes at any time, with or without notice.
3. Accounts and Security
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate any account for any reason, including suspected fraud, excessive returns, chargebacks, or violation of these Terms.
4. Orders, Pricing, and Fraud Prevention
All product descriptions, images, prices, and availability are subject to change without notice. We reserve the right, in our sole discretion, to:
- Refuse or cancel any order;
- Limit or cancel quantities purchased per person, per household, or per order; and
- Correct errors in product listings, pricing, or availability, even after an order has been submitted.
If we cancel an order after you have been charged, we will refund the amount paid for the canceled items. Your order is an offer to purchase; no contract for sale is formed until we accept your order (for example, by confirming shipment).
To protect our customers and business, we use fraud prevention measures that may include age and identity verification, IP logging, device tracking, Address Verification (AVS), CVV verification, and fraud scoring. Orders that show fraud indicators may be delayed, canceled, or refused.
5. Third-Party Products; Retailer Role Only
710 Pipes sells products manufactured by third parties, including pipes, vaporizers, accessories, and related items. We are not the designer or manufacturer of these products. To the fullest extent permitted by law, we make no independent representations or warranties about the design, engineering, safety, or performance of third-party products. Any warranties are provided solely by the manufacturer, and our role is limited to that of a retailer. Nothing in these Terms disclaims any non-waivable rights you may have under applicable law.
6. Shipping, Returns, and Refunds
Shipping, returns, and refunds are governed by our Shipping Policy and Return & Refund Policy, which are incorporated into these Terms by reference. Damaged, defective, or incorrect items must be reported within 48 hours of confirmed delivery, and used products cannot be returned.
7. Intellectual Property
All content on the Site, including text, graphics, logos, icons, images, audio and video clips, software, and their compilation and arrangement, is owned by or licensed to 710 Pipes and is protected by copyright, trademark, and other intellectual property laws. “710 Pipes,” “BURLY PIRATE LLC,” and related names and logos are trademarks of BURLY PIRATE LLC and may not be used without our prior written permission.
8. User Content and Communications
If you submit reviews, comments, messages, or other content to us (“User Content”), you grant 710 Pipes a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display that content in connection with operating and improving the Site and our business. You agree not to submit User Content that is unlawful, defamatory, harassing, fraudulent, misleading, infringing, or that contains malware. We may monitor, edit, or remove User Content at our discretion.
9. No Legal Notices or Service of Process via Website or Email
Communications sent through the Site’s contact forms, live chat, social media, or general email addresses do not constitute legal notice to 710 Pipes, BURLY PIRATE LLC, or any of its officers, employees, agents, or affiliates, and are not authorized channels for service of legal process. Legal notices and service of process must be made in accordance with applicable law and delivered to our registered agent or principal place of business.
10. Disclaimers
The Site and all products, content, and information available through it are provided “as is” and “as available”, without warranties of any kind, express or implied. To the fullest extent permitted by law, 710 Pipes disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
Many products contain glass or metal components that can break, chip, shatter, or cause injury if dropped, mishandled, exposed to sudden temperature changes, or used with excessive force.
Statements on the Site about product uses or effects are for informational purposes only and are not medical advice. Consult a qualified healthcare provider with any health questions.
11. Limitation of Liability
To the fullest extent permitted by law:
(a) No indirect or consequential damages. In no event shall 710 Pipes, BURLY PIRATE LLC, or their owners, officers, employees, or agents be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, data, or goodwill, arising out of or relating to your use of the Site, any products purchased from us, or any third-party conduct or content, under any legal theory, even if advised of the possibility of such damages.
(b) Cap on direct damages. Our total aggregate liability for any direct damages arising out of or relating to the Site, these Terms, or any products purchased from us shall not exceed the greater of (1) the amount you actually paid for the product(s) giving rise to the claim, or (2) one hundred U.S. dollars (USD $100).
(c) Assumption of risk. You acknowledge that our products are intended for use only as directed by the manufacturer and may pose risks if used improperly, modified, or used unlawfully. You are solely responsible for handling glass and metal components with care, inspecting products before use, discontinuing use of damaged items, keeping products away from children and pets, and complying with all applicable laws. You assume all risks associated with improper, modified, or unlawful use.
Nothing in this section limits liability that cannot be limited under applicable law, including liability for our own gross negligence or willful misconduct. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless 710 Pipes, BURLY PIRATE LLC, and their owners, officers, employees, and agents from any third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of: (a) your use or misuse of the Site; (b) your unlawful, negligent, or harmful use or misuse of any products purchased from us, including modification, resale, or use contrary to manufacturer instructions or applicable law; (c) your violation of these Terms; or (d) your violation of any third-party rights; in each case only to the extent caused by your acts or omissions and not by our own negligence or willful misconduct.
13. Third-Party Services
The Site integrates with third-party services, including age verification providers (such as AgeChecker.net), payment processors (such as Authorize.net), and buy-now-pay-later providers (such as Sezzle). Your use of those services is subject to their own terms and privacy policies. We are not responsible for their decisions, including approval or denial of age verification or financing, or for their policies.
14. Links to Third-Party Sites
The Site may link to third-party websites that we do not own or control. We are not responsible for their availability, accuracy, content, products, or services, and your use of them is at your own risk.

We may modify, suspend, or discontinue any part of the Site, and may revise these Terms, at any time. The Effective Date above shows when these Terms were last updated. Your continued use of the Site after changes are posted means you accept the revised Terms.
16. Governing Law and Jurisdiction
These Terms and any dispute relating to the Site, products purchased through the Site, or this Agreement are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law principles. The state and federal courts located in Colorado have exclusive jurisdiction over any such dispute, and you submit to the personal jurisdiction of those courts.
17. Severability
If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and any other policies expressly incorporated by reference, constitute the entire agreement between you and 710 Pipes regarding your use of the Site and your purchases.
