Kratom, or Mitragyna speciosa, is a Southeast Asian tree related to coffee, used for centuries as a remedy. It has stimulant and sedative effects due to its alkaloid compounds. Kratom is available as powder, capsules, extracts, resin, and tinctures, each varying in potency and form.

Colorado Governor Jared Polis signed SB22-120 and SB23-147 (both titled “Regulation Of Kratom Processors”) into law in early 2022. Both measures aim to better regulate kratom products, helping to ensure the purity and quality of kratom powders and extracts before they’re approved for local smoke shop shelves. Under SB23-147, kratom manufacturers must carefully comply with guidelines for documentation and product testing before their kratom products are approved for sale. SB22-120 aims to limit kratom access to minors, imposing requirements for retailers and a fine of $200 for purchasing kratom while under the age of 21.

Wondering whether you can legally buy kratom? As of 2023, approved kratom products can legally be sold by online smoke shops to customers aged 21 or older under U.S. Federal Law. Local laws still prohibit residents of some states and counties from buying kratom online or from headshops in their area.
